TNI Bureau: The Delhi High Court pulled up the city police over the death of Constable Subhash Tomar after not getting satisfactory reply to a plea that sought a CBI probe into the case. The court said that the police commissioner will be summoned if the city police did not file proper response.

The court said that the Delhi police have to file a reply in a proper form. The reply the city police have filed is not acceptable. Warning the police, Justice GP Mittal said that the Commissioner of Police will have to be present in the court for the reply.

The strong reaction from the judge came after the reply was filed in form of a status report by the Deputy Commissioner of Police (Crime) SBS Tyagi, instead of the Police Commissioner.

The court had given 3 weeks to the Ministry of Home Affairs, Delhi government and Delhi police to file their response to a plea filed by Advocate GK Bansal. The petitioner had moved the court seeking a CBI probe into Tomar’s case after contradictory statements came from various officials and the eyewitnesses and medical experts.

Tomar was allegedly beaten up by the protesters during the anti-rape stir at India Gate in the national capital after the 23-year-old para-medical student was brutally gangraped by six people on December 16. Tomar was admitted to the Ram Manohar Lohia Hospital on December 23 and died after two days.

The Delhi police had alleged that Tomar died due to injuries he received during the protests. However, the video footage showed that Tomar collapsed at India Gate during the protests. The eyewitnesses said that he had fallen down, nobody had attacked him.
